Court of Appeals to meet at USI

The Indiana Court of Appeals will hear oral argument at 2 p.m. Thursday, April 6, in Mitchell Auditorium in the Health Professions Center. Judge Mellissa S. May, Judge Michael Carr. L. Darden, and Judge Edward W. Najam will hear the case of Marshall & Ilsley Trust Co. v. Robert G. Woodward Sr. The primary issue on appeal in this case is whether a contingent beneficiary of a trust is entitled to an accounting from a trustee under Indiana law. The case will be argued by appellant’s attorney, Brian P. Williams of Kahn, Dees, Donovan, and Kahn, LLP of Evansville, and appellee’s attorneys, Marco L. DeLucio and Allyson R. Breeden of Ziermer, Stayman, Weitzel, and Shoulders, LLP of Evansville. Each side will be given 30 minutes to argue their case. Often, the judges will ask questions during the presentation. The panel of judges will take the arguments under advisement and issue an opinion in the near future. Due to the Code of Judicial Conduct, the judges will not be able to answer any specific questions about the case, but can respond to general inquiries about the legal system. The judges will be available for photographs either before or after the oral argument. The public is encouraged to attend. Normal courtroom rules of decorum will apply.
